This Indenture Made the Seventh day of June in the Year of our lord one Thousand Seven hundred and Thirty Seven Between Samuel Johnfon of Trenton within the County of Hunterdon and province of New Jersey Saddler of the one part and Joseph Clayton of Trenton within the County and province affors’d Carpenter of the other part Witnefseth that Mahlon Stacy late of the province afores’d in his life Time had Surveyed a Certain parcel of land Situate on the North Side of Afsunpink who did afterwards depart This life by reason Whereof the Same Devolved unto and became the right in law of his Son Mahlon Stacy Who being thereof So Seized did afterwards Convey a parte thereof unto William Trent and the Said Trent afterwards dye Intestate Whereby James Trent became Invested unto the Property of his father as heir at law Who being of the Same So Seised Did Convey a part thereof unto Isaac Harrow and the Said Isaac Harrow by deed dated the Sixteenth day of January {Anno} 1735 did Convey unto George Ely, Jun’r the Quantity of One Quarter of an Acre and Six pearches of Ground Situate on the North Side of Petits run in Trenton and by the Survey thereof lyeth thus bounded Viz: Beginning at a Stone on the North Side of Said run being on the East Side of the road thence along the same North four deg’s (degrees)East one Chaine and forty links to a Stone thence North eighty Deg’s East Two Chaine and Twenty Eight Links by Said Harrow to a Stone by an old Stump then South fourteen deg’s east one Chaine to the afores’d run of Water then South Seventy one deg’s fifteen min (minutes?)West Two Chaine and Seventy three links to the beginning Cornor Containing one Quarter of an Acre and Six pearches of Ground, Which Said George Ely by Indenture bearing date the Twenty Seventh day of may Anno (1736) did Convey one Mojety (Moiety?) or halfe part thereof unto Samuel Johnfon partie to these presents as by the Several xxx (rented? executed?) Conveyances relation being thereunto had xxx more at large appear, Now this Indenture further Witnefseth that the Said Samuel Johnfon for and in Consideration of the Sum of one hundred and twenty pounds Curr’t money of New Jersey to him in hand paid by the Said Joseph Clayton at or before the Sealing and Delivery of these presents the rec’t Whereof he doth hereby Acknowledge and Thereof and every part thereof doth Acquit release and discharge the S’d Joseph Clayton his heirs Ex’rs (Executors) and every of them forever by these presents, hath granted bargained Sold aliened released Conveyed and Confirmed and by these presents doth fully freely and absolutly grant bargain Sell alien release Convey and Confirm unto the Said Joseph Clayton and to his heirs and afsigns forever the aboves’d Mojety or one halfe part of the above Described lott of land With one halfe of the Mill and Mill house thereon and one halfe of the Tan xxx or pitts (best guess) theire Sunk or planted Together With one halfe part of all the hides and Skins belonging to the S’d Samuel Johnson and Joseph DeCou being Now in the Tan Yard or Pitts afores’d as alfo one Mojety or halfe part of all the barke (best guess) Mill Stone Knives buildings and other the Implements thereunto belonging with the ways Waters Water Courses rights Liberties priviledges hereditaments and appurtenances Whatsoever and all the Efstate right Title property pofsefsion and demand of him the S’d Samuel Johnfon and his heirs both in law and equity of in or to the Same or any part thereof and the reversions and remainders, With all the rents Ifsues and profits arising from the Same To have and to hold the Said Mojety or halfe of the Said lott of land and all and Singular the premifses in and by these presents granted and Sold or mentioned to be With their appurtenances unto the S’d Joseph Clayton and his heirs To the only proper use and behoof of the Said Joseph Clayton his heirs and afsigns forever And the Said Samuel Johnfon for him Selfe and his heirs Ex’rs doth Covenant promise and agree to and With the S’d Joseph Clayton his heirs and afsigns by these presents in manner following that is to Say that he the Said Samuel Johnfon Now and at the time of the ensealing and delivery of this xxx (possibly herein) Indenture is the true Sole and lawfull owner of the Said granted land and all other the hereby granted premifses or mentioned to be granted With their appurtenances, and lawfully and abfolutly Siefed thereof and of every part thereof, as of A good Eftate of Inheritance in fee Simple Without any Conditions Contingent Limitation or other thing to alter Change Determine or make Void the Same and that the Said Samuel Johnfon Shall Continue So Seifed thereof and every part, thereof until a good and Indefeisible Eftate of Inheritance in fee Simple Shall be thereof Vested in the Said Joseph Clayton and his heirs According To the purport and True meaning hereof And that freely and Clearly Acquitted and Discharged of and from all and all Manner of former and other Gifts Grants bargains Sales Leases Mortgages Joyntures (best guess) Dowers Intails and of and from all Singular other Titles Troubles Charges Demands and Incumbrances Whatsoever, The Quit rents thereout Ifsuing only Excepted to our Sovereign Lord the King his heirs and Succefsors with The arrearages thereof if any be And that the S’d Samuel Johnfon for him Selfe and his heirs Ex’rs doth Covenant and agree to and with the Said Joseph Clayton his heirs & afsigns that the S’d Mojety or halfe part of the lott of land above Mentioned and all and Singular the premifses hereby granted unto the Said Joseph Clayton his heirs and afsigns Against him the Said Samuel Johnfon and his heirs and against all and every person or persons Whatsoever lawfully Claiming or pretending to Claime any part thereof Shall and Will Warrant and forever Defend by these presents And that the Said Samuel Johnfon and his heirs and all and every other perfon and persons Whatsoever lawfully Claiming or to Claime any Eftate right Title or Intrest of in or to the premifses or any part thereof Shall and Will at any Time or Times hereafter, at the reasonable request Cost and Charge in the law of the Said Joseph Clayton his heirs or afsigns, Make do Execute and Acknowledge or Cause to be, all and every Such further and other lawfull and reasonable act and Acts Deed or Deeds Device or Devices in law Whatsoever for the further and better afsurance and Confirmation of the granted premifses With their appurtenances unto the S’d Joseph Clayton his heirs and afsigns as by the S’d Joseph Clayton his heirs or afsigns or his or their Council learned in the law Shall be reasonably devised advised or required In Witnefs Whereof the Said Samuel Johnfon hath to this present Indenture Sett his hand and Seale the day and Year above Written Anno 1737
