This Indenture made the eighteenth Day of July in the year of our Lord one thousand seven hundred and eighty six, between Stacy Potts of Trenton in the County of Hunterdon and state of New Jersey of the one part, and Jofeph Dye of the same place of the other part, Witnefseth, that the said Stacy Potts, for, and in confideration of the sum of six Pounds fifteen shillings, current Gold or Silver Money at the rate or value of seven Shillings and six pence for one spanish milled Dollar, to be paid by the said Jofeph Dye, his Heirs, Executors, Administrators or Afsigns, unto the said Stacy Potts, his Heirs, Executors, Adminiftrators or Afsigns, on the tenth day of march next, and the like sum on the tenth day of March yearly, and every year hereafter, Hath Granted, Barganed and Sold, and by thefe prefents Doth fully, freely, clear and abfolutely Grant, Bargan, Sell, Enfeof, Releafe, Convey and Confirm, unto him the said Jofeph Dye, his Heirs and Afsigns forever, a certain Lott of Land, situate in Trenton aforesaid, bounded as followeth, Begining at a stone at the North side of the Road from Trenton to Penington, called Penington Street, and runs from thence Northwestwardly along the said Street ninety feet, including a run of Water, thence at right Angles Northeastwardly one hundred and forty feet to a Stone for a Corner, thence at right Angles Southwestwardly ninety feet to a Stone for a Corner thence at right angles Southwestwardly one hundred and forty feet to the place of begining, at the street aforesaid, containing forty six Perches and eighty eight feet of Land, be the same more or lefs, together with all and singular, the Mines, Minerals, Ways, Waters, Rights, Liberties, Previledges, Hereditraments and Appurtenances whatsoever To have & to hold the above described Lott of Land, with all and every of the Appurtenances, particularly the free and uninterrupted ufe of the aforesaid run of Water, in the Northwestwardly corner of the said Lott, unto him the said Jofeph Dye, his Heirs and Afsigns, to the only proper ufe, benefit and behoof, of him the said Jofeph Dye, his Heirs and Afsigns forever.  Provided neverthelefs that if the said Jofeph Dye, his Heirs or Afsigns, shall make default in the payment of the aforefaid sum of six Pounds fifteen Shillings money aforesaid, on the Day appointed for the payment thereof, yearly, and every year, or shall obftruct or dirty the water in the Run Aforesaid, so as to prejudice or damage the Tanyard now belonging to the said Stacy Potts then it shall and may be lawful for the said Stacy Potts his Heirs, Executors, Administrators or Afsigns, and they, or either of them, are hereby impowered, in that café, to enter upon, and take pofsefsion of the said Lott of Land, with all, and every of the Buildings, which may be erected thereon, with their Appurtenances, and the same to convert and Apply to his, and their own proper ufe, benefit and advantage, with the Rents, Ifsues and Proffits thereof, any thing herein contained to the contrary thereof in any wife notwithstanding.  But if the said Jofeph Dye, his Heirs Executors, Adminiftrators or Afsigns, at any time hereafter, shall well and truly pay, or caufe to be paid, unto the said Stacy Potts, his Heirs, Executors, Adminiftrators or Afsigns, the whole principle sum, in like Gold or Silver Money, at the rate or value aforesaid, whofe lawful Interest, at the time of the payment thereof, shall amount to the aforesaid sum of Six Pounds fifteen Shillings yearly, then the above Provifo shall ceafe, and become abfolutely void and of none effect, except what relates to the prefervation of the Tanyard of the said Stacy Potts from injury, by obftructing or dirtying the water, which is ever meant & intended to be preferved inviolable forever, and the said Jofeph Dye his Heirs and Afsigns, forever after the payment of the principle Sum aforefaid, shall have, by virtue of of thefe prefents, a clear and abfolute Title to the Lott of Land aforefaid, with all, and every of the Appurtenances, as a good, sure and Indefeafable Estate of Inheritance in fee simple, free & clear, of & from, all other Incumberances whatfoever, except that of not injuring the Tanyard, as before excepted.  In Witnefs whereof, they the parties aforefaid, hath to thefe prefents interchangably set their Hands and Seals, the day & year above written.  1786-
